These Terms of Service (“Terms”) govern your access to and use of HotelKitchens and any related websites, emails, and services (together, the “Site”), operated by Terrace Solutions, Inc., doing business as HotelKitchens (“HotelKitchens,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. Our service

HotelKitchens is an online travel information and search service. We help you discover accommodations and connect you with third-party travel providers, such as booking sites, hotels, and other suppliers (“Travel Providers”), where you can check availability and make a booking.

We do not own, operate, or manage any property listed on the Site, and we are not a travel agent, tour operator, or seller of travel. We are not a party to any booking or other transaction between you and a Travel Provider, and no agency, partnership, or fiduciary relationship is created between you and us by your use of the Site.

2. Bookings and Travel Providers

When you follow a link to a Travel Provider, or make a booking through a booking page on or connected to the Site, your booking is with that Travel Provider and is governed by its terms, policies, and prices. A Travel Provider may act as the merchant of record for your booking, even where the booking page displays our name.

Travel Providers are solely responsible for their bookings, payments, confirmations, changes, cancellations, refunds, and customer service, and for the accommodations and services they provide. Please direct any questions about a booking to the Travel Provider or the property.

3. Rooms and amenities

Amenities, including in-room tubs, hot tubs, and similar features, may be available only in certain rooms or at certain rates, and may change without notice. A property’s inclusion on the Site does not mean every room includes a particular amenity.

Before booking, you are responsible for confirming with the Travel Provider or property that the specific room and rate you select includes the amenities you want. We do not guarantee that any property, room, or rate includes, or will include, any amenity, and we are not responsible if the room you book or receive does not meet your expectations.

4. Listings and content

Listings, descriptions, photos, ratings, reviews, rankings, labels, and other content on the Site are based on information from Travel Providers, properties, and other third parties, and on our own editorial judgment. We do not inspect properties. While we work to keep the Site accurate, content may be incomplete, out of date, or wrong, and is provided for general information only. Rankings, badges, and awards reflect our opinion and are not a guarantee or endorsement.

Third-party content, including reviews and property photos, belongs to its respective owners and reflects their views, not ours. Third-party names and trademarks, including Jacuzzi®, belong to their owners, and their use on the Site does not imply any affiliation or endorsement.

5. Prices and availability

Prices and availability shown on the Site are estimates, may not reflect current rates for your dates, and may exclude taxes and fees. The final price, availability, and conditions are those shown by the Travel Provider at the time of booking.

6. Affiliate relationships

The Site is free to use. We may earn a commission or other compensation from Travel Providers when you click a link or make a booking. This does not change the price you pay.

7. Health and safety

Hot tubs and similar amenities carry inherent risks. Use them at your own risk, follow the property’s rules, and consult a physician if you have any health concerns. Properties are solely responsible for the condition, maintenance, and safety of their facilities. Content on the Site is not medical or safety advice.

8. Acceptable use

You may use the Site for personal, non-commercial purposes in accordance with these Terms and applicable law. You agree not to:

• scrape, crawl, copy, or extract content or data from the Site by automated means, including for training AI models, without our prior written permission;
• reproduce, frame, mirror, or resell the Site or its content;
• interfere with or disrupt the Site, or attempt to bypass its security;
• engage in fraudulent activity, including manipulating links, clicks, or bookings; or
• submit false, misleading, infringing, or unlawful material.

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms.

9. Submissions

If you send us any content, feedback, or suggestions (“Submissions”), you confirm that you have the right to do so, and you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and distribute those Submissions for any purpose. We have no obligation to use or publish any Submission.

10. Intellectual property

The Site and its content, features, and functionality, including our name and logo, are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to access and use the Site for personal use. All rights not expressly granted are reserved.

Photographs identified in a page's Photo credits section are available under their stated third-party licenses. Those licenses, including any permitted commercial reuse or adaptation, govern those photographs. These Terms and our general rights-reserved notice do not restrict rights granted by those licenses.

11. Copyright complaints

If you believe content on the Site infringes your copyright, please send a notice that complies with the Digital Millennium Copyright Act to our designated agent: Copyright Agent, Terrace Solutions, Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, USA; phone (860) 506-5953; email dmca@useterrace.ai. We may remove content and terminate the access of repeat infringers.

12. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR MAKE ANY WARRANTY ABOUT ANY TRAVEL PROVIDER, PROPERTY, OR BOOKING.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOTELKITCHENS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SITE, ANY BOOKING, OR ANY ACT OR OMISSION OF A TRAVEL PROVIDER OR PROPERTY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

14. Dispute resolution and arbitration

Informal resolution. Before filing a claim, you agree to contact us at support@useterrace.ai and attempt to resolve the dispute informally for at least 60 days.

Arbitration. If we cannot resolve a dispute informally, you and HotelKitchens agree that any dispute arising out of or relating to the Site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may bring an individual claim in small-claims court or seek injunctive relief in court for infringement of intellectual property rights.

Class-action waiver. You and HotelKitchens may bring claims only on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative proceeding. If this waiver is found unenforceable for a claim, that claim will proceed in court, not in arbitration.

Opt-out. You may opt out of this arbitration agreement by emailing support@useterrace.ai within 30 days of first using the Site, with your name and a clear statement that you opt out of arbitration.

15. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Subject to Section 14, the state and federal courts located in Delaware have exclusive jurisdiction. If you are a consumer, you also keep any protections that the mandatory laws of your country of residence give you.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless HotelKitchens and its affiliates, officers, employees, and contractors from any claims, losses, and expenses, including reasonable legal fees, arising from your use of the Site, your Submissions, or your violation of these Terms.

17. Changes to the Site and these Terms

We may modify, suspend, or discontinue the Site at any time. We may update these Terms from time to time and will post the updated version with a new “Last updated” date. Your continued use of the Site after any change means you accept the updated Terms.

18. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them without restriction. These Terms and our Privacy Policy are the entire agreement between you and us regarding the Site.
